Terms and Conditions

Article 1, Definitions
In these general terms and conditions, the following definitions apply:
- Luxury Times: Luxury Times B.V., located at Het Rietveld 55a, 7321 CT Apeldoorn, the Netherlands, registered with the Chamber of Commerce under number 85201790.
- Customer: any natural person or legal entity that enters into or wishes to enter into an agreement with Luxury Times, or to whom Luxury Times makes an offer.
- Consumer: a customer who is a natural person and is not acting in the exercise of a profession or business.
- Agreement: any agreement between Luxury Times and the customer, including agreements for the purchase, sale, trade-in, or consignment of watches.
- Watch: a pre-owned or new watch that is sold by Luxury Times or purchased from the customer.
- Website: luxury-times.nl, including all subdomains.
Article 2, Applicability
- These general terms and conditions apply to every offer by Luxury Times, to every agreement between Luxury Times and the customer, and to every service offered by Luxury Times.
- Before an agreement is concluded, the text of these general terms and conditions is made available to the customer via the website.
- Deviations from these terms and conditions are only valid if expressly agreed upon in writing or by email.
- The applicability of any purchase or other conditions of the customer is expressly rejected.
Article 3, Offers and quotes
- All offers and quotes from Luxury Times are without obligation, unless expressly stated otherwise.
- Offers and quotes do not automatically apply to future agreements.
- The watches and prices displayed on the website provide as accurate a representation as possible. Obvious errors or mistakes in the offer do not bind Luxury Times.
- A quote for the purchase of a watch is valid for the period stated therein. If no period is stated, the quote is valid for 7 days.
- Luxury Times cannot be held to an offer if the customer could reasonably have understood that the offer contained an obvious error or typographical mistake.
Article 4, Price and payment
- All prices stated on the website and in quotes are in euros and include VAT, unless otherwise indicated.
- Payment is made exclusively by bank transfer to a bank account specified by Luxury Times.
- When Luxury Times sells a watch to the customer, full payment must be received before the watch is transferred, unless otherwise agreed in writing.
- When Luxury Times purchases a watch from the customer, payment is made by bank transfer after the watch has been received, inspected, and approved by Luxury Times.
- If the customer fails to pay on time, the customer is in default by operation of law. Luxury Times is entitled to charge the statutory interest from the day payment was due.
Article 5, Delivery
- Delivery of watches takes place in a manner agreed upon by Luxury Times and the customer. This may be through personal handover, insured postal delivery, or courier.
- Stated delivery times are indicative and shall never be regarded as strict deadlines. Exceeding a delivery time does not entitle the customer to compensation or dissolution of the agreement, unless the delay is such that the customer cannot reasonably be expected to maintain the agreement.
- The risk of damage and/or loss of the watch passes to the customer at the time of delivery.
- When shipping, Luxury Times ensures adequate insurance of the watch until the moment of delivery.
Article 6, Right of withdrawal
- When purchasing a watch, the consumer has the right to dissolve the agreement without giving any reason within a cooling-off period of 14 days. This cooling-off period commences on the day after receipt of the watch.
- During the cooling-off period, the consumer shall handle the watch and its packaging with care. The watch may only be unpacked and inspected to the extent necessary to determine the nature and characteristics of the watch.
- If the consumer exercises the right of withdrawal, the watch must be returned to Luxury Times in its original and unworn condition, with all supplied accessories and, where reasonably possible, in the original packaging.
- The costs of return shipping are borne by the consumer. The consumer must return the watch by insured and registered post.
- Luxury Times will refund the purchase amount within 14 days of receiving the returned watch by bank transfer, provided the watch has been received in unchanged condition.
- The right of withdrawal does not apply to agreements where the customer is acting in the exercise of a profession or business.
Article 7, Warranty and authenticity
- Luxury Times guarantees that every watch sold has been verified for authenticity, stolen goods registration, and history. We verify the authenticity of every watch we sell.
- Luxury Times does not guarantee the inclusion of a physical certificate of authenticity. Whether a certificate is provided depends on availability and is stated per watch.
- Luxury Times guarantees that the watch upon delivery corresponds to the description and any photographs provided on the website or in the quote.
- No manufacturer's warranty is provided by Luxury Times on pre-owned watches, unless the watch is still covered by the manufacturer's warranty. This is stated per watch.
- Any defects that have not arisen through normal use and that come to light within 6 months of delivery are presumed to have existed at the time of delivery, unless Luxury Times proves otherwise. In such cases, Luxury Times will, in consultation with the customer, arrange for repair, replacement, or refund.
- Warranty is voided if the watch has been damaged by improper use, dropping, water damage (unless the watch was sold as water-resistant), or if the watch has been opened or repaired by a third party without the prior written consent of Luxury Times.
Article 8, Purchase of watches
- Customers may offer their watch for sale to Luxury Times via the sell form on the website, by email, or by telephone.
- After receiving the request, Luxury Times will make a non-binding offer for the watch as soon as possible, based on the information provided and any photographs.
- An offer from Luxury Times is based on the current market value, the condition of the watch, and the presence of original accessories (box, papers, certificates).
- If the customer agrees to the offer, the watch is personally handed over or sent insured to Luxury Times. Luxury Times inspects the watch for authenticity, condition, and correspondence with the information provided.
- If upon inspection the watch deviates from the information provided, Luxury Times reserves the right to adjust the offer or return the watch.
- After final agreement and receipt of the watch, payment to the customer is made by bank transfer, typically within 2 business days.
- The customer guarantees that he/she is the rightful owner of the offered watch and that the watch is free from attachments, liens, or other third-party claims.
Article 9, Liability
- The liability of Luxury Times is limited to the amount paid out by Luxury Times' liability insurance in the relevant case, or to the invoice amount of the relevant agreement.
- Luxury Times is not liable for indirect damage, including consequential damage, lost profits, missed savings, or damage due to business interruption.
- The limitations of liability in this article do not apply if the damage is attributable to intent or gross negligence on the part of Luxury Times.
- Luxury Times is not liable for damage resulting from incorrect, incomplete, or untimely information provided by the customer.
Article 10, Complaints
- Complaints about the execution of the agreement must be submitted to Luxury Times as soon as possible, but no later than 14 days after discovery of the defect, fully and clearly described.
- Complaints can be submitted by email to info@luxury-times.nl or by telephone at +31 6 30044462.
- Luxury Times aims to process complaints within 14 days of receipt. If a longer processing time is required, the customer will be informed within 14 days with an indication of the expected processing period.
- If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute resolution as described in Article 11.
Article 11, Disputes and applicable law
- All agreements between Luxury Times and the customer are governed exclusively by Dutch law.
- Disputes between Luxury Times and the customer shall be submitted exclusively to the competent court in the district where Luxury Times is established, unless the law mandates a different court.
- Before resorting to the courts, the parties shall endeavour to resolve the dispute by mutual consultation.
Article 12, Changes
- Luxury Times reserves the right to amend these general terms and conditions. Amended terms and conditions apply to new agreements from the moment of publication on the website.
- Existing agreements remain subject to the terms and conditions that were in effect at the time the agreement was concluded.
- Luxury Times will, where possible, inform the customer in a timely manner of changes to the general terms and conditions.
